dc.description.abstractIn Mogale v Minister of Safety and Security 2016 (2) SACR 682 (GP) the high court had dismissed an application sought by the appellants for an order setting aside certain search warrants issued by different magistrates (at paras [10] and [11]). It appeared that the affidavits placed before the issuing magistrates in support of the applications for the respective search warrants had already been prepared and signed before they were presented to the commissioner of oaths for administering the oath.
