Die regsaard en afdwingbaarheid van heffings by deeltitelskemas
Abstract
Sectional title schemes are managed by a body corporate. The financial management of a scheme is the responsibility of the body corporate and the main source of income is the imposition of levies that have to be paid by the sectional owners. This study sets out the way in which levies are imposed and how the amounts of levies are determined. The legal nature of levies is furthermore investigated as well as the consequences of a claim for arrear levies by the body corporate. The problems and practical implications relating to the enforcement, collection and disputes which relate to levies are also indicated. Finally, the study offers a conclusion, practical recommendations as well as considerations to be taken into account where levies and the enforcement thereof are concerned.
