dc.description.abstractTans word die besigheidstrust nie as 'n afsonderlike trustentiteit erken nie. Gevolglik word 'n trust wat vir besigheidsdoeleindes aangewend word en outomaties gepaardgaande "trustregtelike" beskerming geniet, misbruik. Hierdie verhandeling bring aan die lig dat die miskenning van die besigheidstrust as afsonderlike trustentiteit aanleiding gee tot ernstige misbruike. Dit is dan binne hierdie konteks en die feit dat howe al meer deur die gevolge weens die misbruik van 'n trust gekonfronteer word dat 'n ernstige probleem in die Suid-Afrikaanse trustreg ge"fdentifiseer is. Dit is duidelik dat 'n hele aantal uitsprake daarop dui dat die regbank bewus geword het van die misbruike maar nog nie by magte is 6f voldoende statutere ondersteuning het om hierdie misbruike daadwerklik aan te spreek nie. Die afleiding word gemaak dat howe erken dat wetgewing daargestel behoort te word om die besigheidstrust te interpreteer en inhoud te gee aan die verpligtinge wat daardeur op die partye opgele word , om optimale vermindering van die misbruik van die besigheidstrust te verseker. Die situasie soos dit tans in die trustpraktyk bestaan, maak die gevolgtrekking onvermydelik dat daar in 'n rigting beweeg moet word om die onafwendbare misbruike daadwerklik te hanteer. Howe kan egter net 'n suksesvolle bydrae lewer indien die wetgewer geskikte en effektiewe remedies toelaat. Sekere voorstelle word gemaak dat die Trustwet soos dit tans van toepassing is, nie voldoende is nie en verder uitgebrei behoort te word. Presently, the business trusts is not recognised as a separate trust entity. Consequently, trusts are exploited for business purposes and automatically enjoy the legal protection that goes with it. This dissertation brings to light how lack of attention to the business trust as a separate trust entity, results in serious abuse. It is within this context, and the fact that the courts are more frequently confronted with the results of trust misappropriation, that a serious problem has been identified within South African trust law. A number of judgments clearly indicate that the judiciary has become aware of the misappropriation but is, as yet, unable or without the necessary statutory support to take real action against such abuses. The conclusion is that the courts do recognise the need for legislation to interpret the business trust and provide content to obligations imposed on parties through it, thereby ensuring that a reduction in misappropriation of business trusts is optimised. The present situation within trust practice leads to the inevitable conclusion that clear action must be chosen to deal with the unavoidable abuse. The courts are, however, only able to make a successful contribution if the legislature authorises appropriate and effective remedies. Several suggestions are made regarding the current Law on Trusts that is at present inadequate and needs to be augmenteden_US
